Each member is required to read and agree to the following terms of service. It is your responsibility to read, understand, and agree to the SurveyCritic.com terms of service, as well as the SurveyCritic.com privacy policy. In addition, it is your responsibility to note and comply with future changes, amendments, additions, and removals from these two documents. If you do not agree with these terms you may not become a member of SurveyCritic.com. These terms apply only to registered members of SurveyCritic.com.
Description of Service: SurveyCritic.com (Hereafter referred to as "SurveyCritic" and "the Website") is a free service which provides visitors with helpful information regarding paid survey sites and allows its members to earn money by completing surveys. The SurveyCritic service and website (Hereafter referred to as "the Service") shall be provided on an "as is" and "as available" basis. SurveyCritic disclaims all responsibility and liability for the availability, timeliness, security, and reliability of the Service. SurveyCritic reserves the right to change, suspend, or shut down the Service with or without notice, at any time, for any reason, and without any liability to SurveyCritic. Decisions made by SurveyCritic regarding the Service, you, any user or user's account, and any other matter related to the Service shall be final. You acknowledge that SurveyCritic will not entertain an appeal for any decision.
Surveys: SurveyCritic provides surveys to members who reside in certain geographic areas. Credit will only be given for up to one survey per household per day. The default rate per survey completion is one (1) USD, however SurveyCritic reserves the right to modify this at any time. This rate may be increased on a per case basis as a means to reward certain members. You, the member, understand and acknowledge that no credit shall be given to you or any other member until SurveyCritic has received confirmation from its survey providers.
Payments: Members may request payment once their account balance has reached the minimum required to cash out. Payment will typically be sent within 48 hours of your request. If necessary, payments may require additional time in order to be processed. Prior to payment, each account will be audited in order to insure that no fraud has taken place. SurveyCritic will never be deemed as owing payment to any member, but will make payments only after verification of the legitimacy of an account and balance.
Disclaimer of Liability: SurveyCritic shall, at no time, be held liable for any result of the use or misuse of your account, including, but not limited to, termination, suspension, information dissemination, legal proceedings against you, damages (actual or consequential), suits, losses, judgments, litigation costs, attorneys' fees, and any other consequences, of every kind and nature. SurveyCritic will take no responsibility for any activity that occurs on any other website not under the direct control of SurveyCritic.
Non-Commitment: SurveyCritic shall at no time have any commitment toward any user and shall at all times retain a state of non-commitment. SurveyCritic may, at its discretion, terminate the Service, for one, any, or all users, for any or no reason, at any time, without any notice. Upon termination of the Service, SurveyCritic shall remain without commitment toward any user, past or present, terminated, suspended, active, or in any state. SurveyCritic may, at its discretion, discontinue the Service. Upon discontinuation of the Service, SurveyCritic shall remain without commitment toward any past user from any previous period or periods of Service availability or suspension.
Personal Use: SurveyCritic is made available for personal use only. Each user may have a maximum of one account. More than one account is allowed per household, but each account must have a unique email address associated with it and the limit of one survey per day per household still applies. Termination of an account does not merit the creation of a new account. In compliance with the Children's Online Privacy Protection Act of 1998, you must be at least thirteen (13) years of age to use the Service. You must provide current and accurate information upon registration for the Service. Providing false information is considered fraud and may result in the termination of your account. You are solely responsible for keeping your SurveyCritic account and password confidential.
Proper Use: Your use of SurveyCritic implies your agreement to the SurveyCritic Terms of Service (Hereafter referred to as "Agreement"), as well as the SurveyCritic Privacy Policy, and is subject to your acceptance of both agreements. You agree that you will use the Service in accordance to all laws and regulations, whether local, state, or national. You shall never use the Service for any illegal, fraudulent, or inappropriate purpose, nor in any way which violates the Agreement or Privacy Policy. SurveyCritic reserves the right to investigate your use of the Service by its own volition or per request made by the authorities. You are responsible for every consequence of your account's use. Any attempt to undermine the security of the Website, including but not limited to gaining access to areas or information you are not authorized to access or modifying any portion of the Website, will result in the termination of your account and possible legal action.
Content: SurveyCritic takes no responsibility for third party content, including, without limitation, any viruses or other disabling features. A third party is defined as any entity that is not SurveyCritic. SurveyCritic has neither responsibility nor obligation to monitor third party content. SurveyCritic reserves the right to edit, remove, or refuse to post any content, at any time, including, but not limited to, third party content. Removal or refusal to distribute information will be left solely to the discretion of SurveyCritic.
Comment System: SurveyCritic provides members with a means to comment on specific survey sites that may be read by other visitors to SurveyCritic, including non-members. This comment system is provided to allow user interaction with the Website and is not to be used for self-promotion or to post inappropriate and/or offensive material. Misuse of the comment system will result in termination of your account and a loss of all unpaid earnings. SurveyCritic reserves the right to edit comments to any extent at its sole discretion.
Representations: You warrant that all of the information provided by you to SurveyCritic to participate in the Service and website is accurate and current. You further warrant that any information given to third parties from our site is accurate and current. You warrant that you have all the necessary rights and authority to enter into this agreement and to perform the acts required of you by the Service.
Privacy: As a condition to using SurveyCritic, you agree to the full terms and conditions of the Privacy Policy, including any changes that may be made, at any time, without any given notice, and for any reason. It is your responsibility to find and read the Privacy Policy and any future amendments to said policy.
Referrals: SurveyCritic does not currently have a method for crediting current members for referring new members. SurveyCritic reserves the right to change this at its discretion.
Termination: You may cancel your use of the SurveyCritic Service at any time by contacting the site administrator and requesting the removal of your account information. SurveyCritic may, at its discretion, terminate any account for any reason and at any time, without any prior notice or warning. Members whose accounts have been terminated by SurveyCritic for any reason shall lose any and all potential benefits associated with the Service. SurveyCritic shall neither offer nor owe anything to users whose accounts have been terminated or suspended. Users whose accounts have been terminated remain subject to this Agreement and Privacy Policy. Any part of the Agreement or Privacy Policy directed solely toward active members shall not apply to terminated users.
Indemnification: You agree to hold harmless and indemnify SurveyCritic, its affiliates, agents and all members from and against any third party claim arising from or in any way related to your use of the Service, including, but not limited to, any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys' fees, of every kind and nature.
Severability: You agree that the terms of this Agreement are severable. If any part of this Agreement is determined to be unenforceable or invalid, that part of the agreement will be interpreted in accordance with applicable law as closely as possible, in line with the original intention of both parties to the Agreement. The remaining terms and conditions of the Agreement will remain in full force and effect.
Entire Agreement: You agree that this Agreement, including the policies and agreements it refers to (i.e. the Privacy Policy), constitute the complete and only Agreement between you and SurveyCritic regarding the Services contemplated herein. In the event that any other statement from SurveyCritic is in conflict with the Agreement, the Agreement shall control.
Waiver: The failure of SurveyCritic to enforce any of the provisions within this Agreement against you or others shall not be construed to be a waiver of the right of SurveyCritic thereafter to enforce such provisions.
Force majeure: SurveyCritic will make every effort to maintain the availability of the Service to its members. However, certain technical difficulties and other factors outside of its control may, from time to time, result in temporary service interruptions. You agree not to hold SurveyCritic liable for any of the consequences of such interruptions.
Headings: The headings in the Agreement are descriptive only and in the event of a conflict between a heading and the underlying terms of this Agreement, the terms of this Agreement shall control.
